Membership & Sales Agreement

Smart Beauty – Bluesense AI Inc.

1. Definitions

This agreement refers to the Smart Beauty mobile application, developed by Bluesense AI Inc., as the “App.” The terms “we,” “us,” or “our” refer to Bluesense AI Inc. “You” or “user” refers to anyone using the App within the European Union.

Membership means your access to digital skincare services through the App. A subscription is a paid, automatically renewing plan. Digital services include AI-based skin analysis, personalized skincare recommendations, and progress tracking.

2. Membership Types and Features

You may access the App with a free or paid membership.

Free members can use basic features. Paid subscribers get access to premium services like advanced skin analysis, personalized recommendations, and progress history. The details of each plan are shown before purchase.

3. Subscription Fees and Payment Terms

Subscription prices and billing cycles are shown clearly before payment. All payments are processed securely via the App Store or Google Play, and your payment information is handled according to GDPR standards.

By subscribing, you give permission for the selected platform to charge your chosen payment method. Taxes (like VAT) may apply based on your country.

4. Cancellation and Refund Policy

As an EU consumer, you have the right to cancel your subscription within 14 days of purchase without giving a reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).

To exercise your cancellation right within this period, email us at privacy@bluesense.ai clearly stating your intention to cancel. We will confirm receipt of your cancellation request within 48 hours.

If you have started using premium features during this 14-day period, we may deduct an amount proportional to your use of the service up to the cancellation date, based on clear and verifiable criteria.

After the 14-day period has expired, cancellation will take effect at the end of your current billing cycle, and refunds will not be provided for the ongoing billing period.

5. Auto-Renewal Notification

All paid subscriptions renew automatically unless cancelled.

We show clear renewal terms before purchase.

You can cancel auto-renewal anytime in your account settings or via the App Store/Google Play.

After cancellation, you will not be charged for the next period.

6. Termination of Agreement

We may suspend or terminate your access immediately in cases of serious violations (e.g., misuse of data, fraud) or with 7 days prior notice for less serious violations.

You may terminate your membership at any time by deleting your account or cancelling your subscription. Access to premium features will end after cancellation.

7. Legal Disputes and Jurisdiction

This agreement is governed by EU laws and the laws of the country where Bluesense AI Inc. is based.

If you live in the EU, you may bring legal matters to the courts of your own country under mandatory consumer protection laws. We aim to resolve disputes fairly and cooperatively.
