Terms of Service – Smart Beauty (Canada)

1. Introduction and Definitions

These Terms of Service (the “Agreement”) govern the use of the Smart Beauty application (“App”) provided by Bluesense AI Inc. (“Bluesense”, “we”, “us”, or “our”). By accessing or using our App, you agree to be bound by this Agreement, including all applicable Canadian laws, including federal and provincial consumer protection legislation, competition regulations, contract principles, and e-commerce rules.

2. Scope of Services

Smart Beauty is an AI-powered skincare platform designed to:

• •Analyze facial skin conditions (e.g., acne, wrinkles, UV damage)
• •Provide personalized cosmetic recommendations
• •Track skin health progress
• •Facilitate clinic and brand integrations
• •Offer educational content and loyalty programs

Important: Smart Beauty is not a diagnostic tool and does not provide medical advice. Recommendations are cosmetic in nature and not intended to replace professional healthcare judgment.

3. User Responsibilities

By using the App, you agree to:

• •Provide accurate and truthful information
• •Maintain the confidentiality of your login credentials
• •Use the App for lawful, personal purposes only
• •Abide by all community and content rules

You acknowledge that any consequences resulting from false data or misuse are your responsibility.

4. Account Creation and Access

You must be at least 14 years old to use Smart Beauty. Account creation requires a valid email address or social login. We may suspend or terminate accounts at our discretion if there is a breach of these terms.

5. Prohibited Uses

You may not:

• •Use the app for emergency or clinical diagnosis
• •Interfere with, reverse-engineer, or exploit our services or AI

6. Modifications to Services and Access

Bluesense reserves the right to:

7. Intellectual Property Rights

All content, algorithms, logos, and trademarks are owned by Bluesense AI Inc. User-submitted content (e.g., reviews) remains yours, but you grant us a royalty-free license to use, display, and adapt it for service improvement and marketing purposes in an anonymized format.

8. Limitation of Liability

Bluesense AI Inc. is not liable for:

• •Skin reactions or outcomes resulting from product use or AI suggestions
• •Errors or inaccuracies in AI predictions
• •Third-party service failures

To the fullest extent permitted by law, our total liability shall not exceed CAD $100.

9. Dispute Resolution and Jurisdiction

This Agreement is governed by the laws of British Columbia and the federal laws of Canada. In case of disputes, you agree to contact us first. If unresolved, disputes shall be handled in the courts of British Columbia, Canada.

10. Changes and Notifications

We may update this Agreement periodically. Material changes will be communicated via app notification or email. Continued use after updates signifies acceptance of revised terms.

13. User Content and Community Standards

• •Agree not to submit defamatory, obscene, or unlawful content
• •Understand that public posts are visible to others and may be retained by us

14. Subscription, Renewals, and Cancellations

If Smart Beauty offers paid services:

• •Users will be clearly informed of charges and renewal terms
• •Cancellation is available at any time via in-app settings
• •Refund policies, if applicable, will be provided during the purchase process

By subscribing, you agree to the recurring billing terms unless canceled beforehand.
