1. INTRODUCTION

These Terms of Service (“Terms”) apply to your use of the Smart Beauty mobile application (“App”) provided by Bluesense AI Inc. (“Bluesense”, “we”, “our”, or “us”). By using the App, you accept and agree to comply with these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. SERVICES

The Smart Beauty App provides:

• •AI-based cosmetic skin assessments using uploaded images;
• •Personalized skincare and cosmetic recommendations;
• •Informational content on wellness and beauty;
• •Optional premium features and in-app purchases.

Note: Smart Beauty does not provide medical advice, diagnoses, or treatment. The content is for informational and cosmetic purposes only.

3. ELIGIBILITY

You may use the App only if:

• •You are 14 years or older, or you have verifiable parental or guardian consent;
• •You provide accurate and lawful personal data;
• •You do not upload images or data of others without their explicit consent.

4. ACCOUNT RESPONSIBILITIES

If you create an account, you agree to:

• •Keep your login information secure;
• •Be responsible for activity on your account;
• •Notify us immediately if you suspect unauthorized access or misuse.

We may suspend or terminate accounts that violate these Terms or applicable law.

5. PROHIBITED USES

You may not:

• •Violate any law or third-party rights;
• •Interfere with or disrupt the App’s operations;
• •Reverse-engineer, decompile, or tamper with the App;
• •Use the App for commercial purposes without our written consent.

6. MODIFICATIONS TO SERVICE

We reserve the right to:

• •Modify, suspend, or discontinue the App or any part of it without prior notice;
• •Restrict access as needed for legal, technical, or operational reasons.

We are not liable for interruptions or changes to the App.

7. INTELLECTUAL PROPERTY

All intellectual property rights in the App, including algorithms, branding, and interface design, are owned by Bluesense or its licensors. Unauthorized copying, reproduction, or distribution is prohibited.

8. LIMITATION OF LIABILITY

To the extent permitted by law:

• •The App is provided “as is” and “as available” with no warranties;
• •We are not liable for indirect, incidental, or consequential damages;
• •Results are informational and not guaranteed to be accurate for every user.

This clause does not limit rights under applicable Brazilian, Mexican, or Argentine consumer laws.

9. REFUNDS

Users may cancel qualifying purchases according to local law:

• •Brazil: 7-day withdrawal right (Consumer Protection Code, Art. 49);
• •Mexico: Refunds for non-conforming services (Art. 92 BIS);
• •Argentina: 10-day cancellation right for digital services (Law 24.240, Art. 34).

Submit refund requests to support@bluesense.ai with proof of purchase.

10. GOVERNING LAW

This agreement shall be governed by:

• •Brazilian law for users in Brazil (São Paulo courts);
• •Mexican law for users in Mexico (Mexico City courts);
• •Argentine law for users in Argentina (Buenos Aires courts).

Users agree to attempt amicable resolution before initiating formal legal action.

11. CHANGES TO TERMS

We may update these Terms for legal, technical, or operational reasons. When we do:

• •Continued use of the App implies acceptance of the updated Terms.
