Smart Beauty App – Bluesense AI Inc.

1. Introduction

This Biometric & Health Data Consent Form (“Consent Form”) explains how and why we, Bluesense AI Inc. (“Bluesense”, “we”, “our”, or “us”), collect and process your facial images and health-related information through the Smart Beauty app. Your explicit consent is required before any biometric analysis can take place.

If you do not agree, do not proceed with any skin analysis features that involve biometric data.

2. Types of Biometric and Health Data Collected

By using Smart Beauty’s AI-powered skin analysis, you may voluntarily provide:

Facial images and video selfies
Data on skin conditions: acne, wrinkles, pores, redness, oiliness, hydration, UV damage
Body area images (if applicable)
Metadata such as skin sensitivity, past issues, and hydration history
Any input during virtual consultations or skin tests

These data types may constitute biometric identifiers and sensitive health information under Canadian privacy law.

3. Purpose and Legal Basis for Processing

Your data is processed for the following purposes:

To analyze your skin using AI models
To generate personalized skincare suggestions
To allow visual skin tracking over time
To improve accuracy of Smart Beauty algorithms
To provide teledermatology support (if applicable)
If opted in, to contribute anonymized data to R&D

Legal Basis:

Processing is done only with your explicit and informed consent, in line with PIPEDA, BC/Alberta PIPA, and GDPR Article 9. Consent must be freely given, specific, informed, and unambiguous.

You must provide clear affirmative consent (via checkbox or “I Consent” tap) before using biometric-based features.

You may withdraw consent at any time by emailing us at privacy@bluesense.ai or via app settings. This will immediately disable biometric features and trigger data deletion unless legally required otherwise.

5. Data Storage & Retention

Facial images are encrypted and stored on secure Canadian (or adequate jurisdiction) servers
If user consents to save analysis results, data is stored for up to 12 months, after which it is anonymized or deleted
If user declines retention, biometric data is deleted within 30 days of analysis
You can request early deletion by contacting us

6. Your Rights

Under PIPEDA and provincial laws, you have the right to:

Access a copy of your biometric/health data
Request correction or deletion
Withdraw consent without penalty
File a complaint with the Office of the Privacy Commissioner of Canada or local authority

7. Third-Party Access

We do not sell or share your biometric/health data with advertisers.

We may only share:

With secure, Bluesense-approved data processors
With dermatology professionals (only upon user request)
When required by law (court order, investigation)

All third parties are contractually bound to maintain data confidentiality and security.

8. Security Safeguards

AES-256 encryption for data in transit and at rest
Access controls with role-based permissions
Periodic audits, secure infrastructure
Compliant with PIPEDA, GDPR, and provincial privacy laws

9. AI Limitations and Medical Disclaimer

Smart Beauty’s AI is not a diagnostic tool
It does not replace medical advice or treatment
All results are informational only, and you should consult a healthcare provider for medical concerns
AI-based insights may contain limitations, bias, or inaccuracies

By selecting “I Consent” within the Smart Beauty app:

I explicitly consent to Bluesense AI Inc. collecting and processing my biometric and health data.
I understand this is for AI-driven cosmetic skin analysis and not a substitute for medical diagnosis.
I understand I can withdraw this consent at any time.
